Terms and Conditions
Clause 1. Pls. note that all orders are subject to the approval and acceptance by Hua Hin Solar Co., Ltd. The following terms and conditions apply to all orders, and are subject to change without prior notice. Pls. know that the Terms and Conditions serve to protect agreements between Hua Hin Solar Co., Ltd (the Seller/Contractor/”Solar Shop Hua Hin”) and the Buyer (our Client/Employer/Owner of Property where the Solar Installation will Occur). They should act/serve to give the our customers “Peace-of-Mind.” By signing the Employer-Contractor Agreement you have agreed to the following Clauses. By signing the Employer-Contractor agreement for the solar installation, you as the Employer (our Customer/Client) have read and understand the provisions hereof thoroughly. You as the Employer have agreed that the Terms and Conditions listed here (displayed openly on this website for complete transparency) are deemed to be an integral part of the Employer-Contractor agreement.
Clause 2. Warrantees commence upon the date of purchase from Solar Shop Hua Hin (our solar panels and other products) or the date of bill of laden (our solar powered products and other products) or the date of install / customer online registry (our Solax, GoodWe and Kolsat inverters, Solax WiFi pockets, zero export meters, and other products). Manufacturer warrantees, and the conditions noted therein, of the products purchased will be honoured. Our staff will help see manufacturer warrantees through for a 24 month period following purchase (equipment) and or installation (solar system). For all warrantee claims and commitments charges for services – including, but not limited to, uninstall, install and shipping to the supplier/manufacturer – may apply. By signing the purchase agreement contract you as the customer agree in full that you will provide access (User and Password) for the system app to Hua Hin Solar Co., Ltd, for maintenance and data review. Know that if you need our help with your solar system we require full access to your app data.
Clause 3. Unless otherwise specified in the contract, Hua Hin Solar Co., Ltd. installations in Thailand come with a 24 month limited warrantee (for solar system products and the normal operation of the installed system only and includes system check-ups and maintaining lead acid batteries). By signing the contract you agree that Hua Hin Solar Co., Ltd, will not be held responsible (limited warranty on our work does not apply to) in anyway for equipment manufacturer defects from the factory nor Application/software issues regarding data presentation and values generated and overall App function -as this is the responsibility of the production factory. The 24 month limited warrantee does not apply to”Do-It-Yourself” or “DIY” solar systems nor for systems in which the customer supplies his or her own solar equipment nor addition of new equipment to older solar system installs. During the warrantee period Hua Hin Solar will repair or replace any item sold by our team that proves defective in material or workmanship without charge. In such case please notify our staff concerning the defect firstly. Upon satisfaction that our warrantee conditions have been met please send the defective item with freight prepaid. The item must be shipped in packaging providing over-protection for shipping purposes. Please provide proof of purchase and a brief explanation of the defect in the package. Please also be comforted by the fact that our parent company (major partner) in Bangkok which will aid warrantee commitments. So you have a security network in place in perpetuity when you purchase your Solar Shop Hua Hin solar system/equipment.
To expound on the manufacturer and performance warrantees for the equipment Solar Shop Hua Hin offers. Most items on the website (including all lead acid/carbide batteries and CKS/Kolsat off-grid inverters) come with a 1 year manufacturer warrantee. Our Solax inverters come with 5 or 10 year manufacturer warrantees (as noted on your Employer-Contractor contract and also see Solax data sheet for details). Our Triple Power lithium batteries also come with a 10 year warrantees respectively when purchased with one of our Solax hybrid (battery backup) inverters. Our solar panels (depending on brand and model) come with 10, 12 or 15 years guarantee (as noted on your Employer-Contractor contract and also see solar panel data sheet for details) on product material and workmanship and a 25-year performance warranty. It is pretty simple to understand how they have setup the performance warrantee. Draw a straight line draw from over 98% at purchase to over 80% at year 25. If the panel output drops below this line it can meet warrantee obligations. Pls. ask us anytime about warrantees for our equipment. Our 1 and 3 phase export control meters have a 1 year warranty.
Cleaning of solar panels, if need be, will be provided as a service at extra charge. Wiring / re-configuring, if need be, as a result of changes to /replacing of the home electrical systems (by, for example, a third party electrician/technician) will be provided as a service, but at extra charge. Follow-up service does not apply to “Do-It-Yourself” or “DIY” solar systems nor for systems in which the customer supplies his or her own solar equipment.
Clause 4. Our warrantees for our products and solar energy systems are limited and do not cover Force majeure (storm – strong wind and or heavy rain damage -, lightning strike, over voltage, fire, thunderstorm, flooding, plant or structural collapse/debris, disease outbreak, etc.), misuse (such as accidentally damage or improper start up or operation) and corrosion. Damage from faulty electrical systems and electrical surges from the city/third party power sources at the installation site are not covered by our warrantee. Unauthorized repair attempts: Modifying/repairing/reconfiguring installed systems without the written permission from Hua Hin Solar management shall void the warrantee. Please know that on the day of solar system installation (agreed upon by the Hua Hin Solar management and you as the client) the client has full right to declare that they do not want full system setup, including but not limited to not setting up WiFi monitoring or not installing an energy export meter. Hua Hin Solar would honour your request, but Hua Hin Solar reserves full rights to charge for the setup/installation of such items, if they are deemed by the client to be required for installation at a later date.
Clause 5. Hua Hin Solar will not be held responsible for delay in product delivery or commencement date of installation, and also reserves the right to cancel accepted orders, if circumstances beyond the companies control – including but not limited to Acts of God (weather, fire, floods, etc.), delay in delivery of products from our suppliers, change in the quality or appearance of products provided by our suppliers, restrictions imposed by law, and so on – cause our company to be unable to timely deliver pursuant to such order. We strive to be honest and transparent and will be due diligent in informing our customers with pertinent details of any such changes. Please also understand that orders cannot be cancelled after they have been processed.
Clause 6. Hua Hin Solar will not be held responsible for delay in installation due to delays in completion or other related construction or service-related issues with the development manager/owner. This especially applies to the on-going development / construction company obligations to provide correct power supply to the owner’s property (i.e. correct single or three phase or repair/replace faulty/damaged community electric-grid equipment). Hua Hin Solar will honour completion of the solar system installation as agreed upon in the quote and on with the client at the time of installation (see Clause 5) (because as engineers we wish to deliver what we promise) as soon as the issues between the property owner and property development/construction or service-management providing companies are resolved. With regards to delays in completion or other related construction or service-related issues with the development manager/owner, Hua Hin Solar Co., Ltd., shall not in any case be liable for costs incurred due to labour, lost profits, lost solar system power generation or revenues.
Clause 7. With regards to Clause 4, product repair or replacement – pursuant to our warrantee, and with regards to Clause 5, Clause 6 and Clause 7– Hua Hin Solar Co., Ltd., shall not in any case be liable for costs incurred due to labour, lost profits, lost solar system power generation or revenues. Hua Hin Solar shall not be liable for special, incidental, consequential, indirect or other similar damages arriving from breach of warrantee, breach of contract, negligence, or any other legal theory even if Hua Hin Solar or our agent has been advised of the possibilities of such damages.
Clause 8. Our installations will be performed following our team’s solar system design – with the goal of optimising output. Any special requirements/conditions regarding the solar system design must be specified/provided by the customer 7 days prior to installation. The requirements must be agreed upon with the Hua Hin Solar management and signed off in the contract in this time period. Any modifications to our design thereafter may be chargeable. Standard quotations do not include overview graphics or schematics of the installation plan/equipment installs. These items as well as sign off by a professional engineer can be provided at extra cost.
For battery backup systems (EPS or “Emergency Power Supply”) the specified loads to be powered during grid shut down (“black outs”) will be listed on the contract-agreement. If during electrical assessment / solar system installation our team discovers that any particular load is connected electrically to other loads (thus risking overloading the solar system and or unacceptably reducing the time you can backup your loads) Hua Hin Solar Co., Ltd. reserves the right to not backup that particular load. If the home owner wishes to have this load backed up with EPS power supply we will be happy to discuss provision of this service, however, in regards to this provision, additional electrical works may be chargeable to the owner. Hua Hin Solar Co., Ltd. will be granted fully by the home or business owner final say (decision making) as to what will and will not be backed up in EPS mode by the solar system.
Clause 9. For on- or off- grid solar system installations, home or business owners wilfully grant Hua Hin Solar unconditional permission to connect to the house-hold electrical control panel and site battery backup banks as agreed between the owner-installer. The owner shall take full and sole responsibility for all outcomes (including electrical faults, household damage or personal injury) in regards to connection of the solar system to the household electrical and grounding systems. Obviously Hua Hin Solar cannot be held accountable for, and is not responsible for, previous electrical works / systems on site.
Clause 10. As our team cannot be on-site to monitor security or electrical safety, it is the owners sole responsibility to keep occupants and visitors (family and otherwise) away from Hua Hin Solar installed electrical works, solar systems and battery backup banks. With safety in mind, we will install security doors with lock(s) for your battery bank upon request.
Clause 11. Hua Hin Solar Co., Ltd. will not be held responsible for breach of owner-development agreements or warrantees, nor owner-insurance agency agreements in connection with Hua Hin Solar solar system installations, renovations, refurbishings or new-builds. For grid-connected solar systems, home or business owners wilfully grant Hua Hin Solar unconditional permission to connect the solar system(s) to the grid and home electric works. The owner shall take full and sole responsibility for all outcomes, including but not limited to those with development owners and pertinent electricity / government authorities, with respect to the grid-connected solar system. Please know that Hua Hin Solar operates and installs solar systems based on the most up-to-date information company management has privy to and or has received directly from pertinent companies, corporations, authorities and institutions both in Thailand and abroad. With regards to solar system sales, and service interpretations, offers and installations, whereas we will honestly strive to remain current (and keep our customers current) with existing and new rules, laws and regulations, Hua Hin Solar shall not be liable for costs incurred – including but not limited to – labour, lost profits, lost solar system power generation, required modifications of solar systems or revenues — resulting from infringement / breach of property development and or pertinent electricity / government authority rules, by-laws, statutes, regulations, private / public /individual practices. Further to this, for property owners with PEA meters: By signing the Employer-Contractor agreement you acknowledge that you have been notified by Hua Hin Solar Co., Ltd and fully understand that your are required to include an energy export meter with your solar system, and, the energy export meter is to be set so that your PEA meter does not spin backwards. You fully acknowledge that you have a full understanding of the process for obtaining a permit to sell to the grid and or register your system with the PEA/Ministry of Energy (MOE). You will not hold Hua Hin Solar Co., Ltd. accountable for your decisions made and your, Hua Hin Solar Co., Ltd ‘s or any third party (hired by Hua Hin Solar Co., Ltd. or yourself) actions taken in regards to registration to sell to the grid or to declare/register your system for a 1-way meter at any time including after installation of your solar system. Further to this, if you do not possess a permit to sell your solar system’s power to the grid at the time of installation of the solar system, you understand that it is your responsibility solely to register your system with the PEA office in Hua Hin or directly in Petchaburi (to declare/register your system for a 1-way meter install) as soon as possible following installation. We will be happy to assist in registration for our customers, but this will come at extra charge for the documents and services required. If you pay us to register your solar system and the PEA changes it’s requirements for registry, you grant us full permission to charge you extra for additional costs or fees required by the PEA/MOE during the registration process. So far this has not happened. So far registries are being granted but do take time to complete. Knowing this, by signing the contract-agreement, you also fully acknowledge that Hua Hin Solar Co., Ltd. can not guarantee that your solar system will be registered by the PEA/MOE. You also fully acknowledge that Hua Hin Solar Co., Ltd. shall not be liable for costs incurred – including but not limited to – labour, lost profits, lost solar system power generation, required modifications of solar systems or revenues — for PEA/MOE offerings and or PEA/MOE ability/willingness to complete solar system registry and or the time required to complete your solar system registry– specifically regarding normal registry or license to sell to the grid.
Clause 12. You as the client agree and understand fully that solar system output and sizing estimates (provided by Hua Hin Solar Co., Ltd staff or agent either verbally or by email correspondences, social media channels and or any other communication means for the sale of solar system design and or solar system/construction installation at the customer’s property) are indicative (estimates only – albeit our best estimates based on our experience). You further agree and understand that solar system reductions in electric bills will vary month to month due to, but not limited to, changes in your household power use, local weather patterns and the positions of the sun in the sky throughout the year. You as the client agree and understand that the solar system outputs and sizing estimates quoted and or installed by Hua Hin Solar Co., Ltd are based upon (including but not limited to) assumed average Thailand solar irradiance conditions collected by the Ministry of Energy for decades, the energy use data (electric bill) you provide us, your roof plan/construction/house orientation to North and our engineer’s experience installing and monitoring Hua Hin Solar Co., Ltd solar systems. You as the client agree and understand that solar system outputs, sizings and drops in electric bills can also vary according to other factors including household consumption behaviour, the electrical and or smart system(s)/wiring/work installed at the property, the design of the solar system, the equipment you purchased, the way the system is programmed, and the electric bill rate (Baht/unit) you pay monthly. When Hua Hin Solar Co., Ltd staff or agent(s) provide you as the client estimated outputs and sizings (quoted and or installed) for a particular solar system, you agree and understand fully that Hua Hin Solar Co., Ltd., shall not in any case be held responsible for special, incidental, consequential, indirect or other similar damages or losses due to labour, lost profits, revenues or any other legal theory even if Solar Shop Hua Hin or our agent has been advised of the possibilities of such damages for use of (a) calculated result(s)/output(s) for any personal or business activity(ies), recommendation(s) or conclusion(s).
Clause 13. You as the client agree and understand fully that Hua Hin Solar Co, Ltd., does not provide a guarantee/warranty limited or otherwise for property structural works (land and structures built on land) and other items (attached or loose) to the structures (including but not limited to roof, electrical systems, drainage, plumbing, pumps, air conditioners, fans, Wifi routers, lighting, curtains, furniture, books, art, painting, wood works). For claims of damage resulting to a property incurred during Hua Hin Solar installations, renovations or construction works the client and Hua Hin Solar management must firstly meet and both agree that the installer is responsible for the damage. Once the later is satisfied, Hua Hin Solar will be diligent in repairing to restore, within reasonable limits / capabilities (available in Hua Hin, Thailand), the property to as close as possible to prior condition. Please note that in following Thai law compensation for damaged property will follow standard depreciation of original value according to the years of ownership. The staff of Hua Hin Solar will either perform the repair / replacement job directly and or will be the sole solicitor (i.e. Hua Hin Solar’s choice solely) of a third party contractor to complete the works required. Whereas every effort will be made to reach agreement regarding completion of reparation works, if a dispute results from the damage claim, to provide resolution Hua Hin Solar shall be granted full rights to determine if and when the repair job is completed (and the damage claim closed without further action by the owner).
Clause 14. Payments made to Hua Hin Solar Co., Ltd for purchase of a solar system installation and or solar / electrical equipment purchase, unless deemed otherwise by the management of Hua Hin Solar Co., Ltd, are non-refundable. Hua Hin Solar Co., Ltd accepts cash or money transfer to our Hua Hin Solar bank account for all payments for rendered services to it’s valued customers. We are happy to note that to this date, we have successfully delivered on what we have promised to do in our contracts and are happy to report that to this date, we have never had a customer not pay in full what is owed to Hua Hin Solar Co., Ltd. according to the signed contract. Thank you for your business! With regards to late payments, the management of Hua Hin Solar Co. Ltd. will as lenient as possible if a valid reason is provided as to why the payment is late – so please maintain open communication with us and we will be as reasonable as possible. Please be rest-assured that we are a family-run business with a big heart. Having said this, the terms (schedule) of payment are clearly stated on each quoted contract and when the customer signs off on the document the customer binds him- or her-self to the payment structure outlined. If all payments noted on the purchase agreement have not been paid in full, any breach of the clauses noted in these Terms and Conditions can result in the following actions being taken by Hua Hin Solar Co., Ltd. By signing the quotation contract the customer understands and agrees in full that after a period of 7 days following each payment milestone, as noted in the contract agreement (i.e. First Payment, Equipment Delivery, Install Completion), payment is over due and late payments can (at the discretion of Hua Hin Solar Co., Ltd. management) be subject to the rate of late payment equal to 1.25% of amount(s) owed/month until such time the customer pays in full the payment milestone to Hua Hin Solar Co., Ltd.. The customer understands clearly that, once the contract is signed, they do not own Hua Hin Solar Co., Ltd., installed solar system(s), electrical system(s) and or construction works (including but not limited to solar panels, inverters, roof/ground mountings, wiring/electrical works, electric control boxes, construction materials), rather these items remain the property in ownership of Hua Hin Solar Co., Ltd., until all payments listed in the terms (schedule) of payment in the Employer-Contractor agreement contract have been made.
By signing the Employer-Contractor agreement the Employer/customer agrees in full that after a period of 30 days of late payment from the date of delivery of equipment and or installation, unconditional and unrestricted access to the Employer/customer property where the installation has been performed, will be provided to Hua Hin Solar Co., Ltd. management and staff, and Hua Hin Solar Co., Ltd. management and staff will be granted full, unconditional and unrestricted right(s) to uninstall and remove from the property installed solar system(s), electrical system(s) and or construction works (as per the signed Employer-Contractor Agreement). Hua Hin Solar Co., Ltd., management will be granted the right(s) to do with the confiscated equipment and materials as it wishes. The property owner also agrees to also forfeit all payments previously made to Hua Hin Solar Co., Ltd. So please make all necessary preparations to make your payments on time.
If a third-party (i.e. another solar installation company or private contractor) is brought in by the property owner to install solar system equipment or to provide services already agreed upon in the Employer-Contractor agreement with Hua Hin Solar Co., Ltd., without the expressed permission/agreement of the management of Hua Hin Solar Co., Ltd, the owner agrees that Hua Hin Solar Co., Ltd. will have the right to re-possess all installed Hua Hin Solar Co., Ltd. solar system equipment and associated electric works immediately from the owner’s property. This is because 1) until the final payment has been made following the contract any item from the solar system / electrical works are still owned by Hua Hin Solar Co., Ltd and 2) Hua Hin Solar Co., Ltd will forbid operation of it’s solar system / electrical works with third party equipment. Immediate, unconditional and unrestricted access to the Employer/customer property where the installation has been performed, will be provided (by the property owner) to Hua Hin Solar Co., Ltd. management and staff, and Hua Hin Solar Co., Ltd. management and staff will be granted (by the property owner) full, unconditional and unrestricted right(s) to uninstall and remove from the property installed solar system(s), electrical system(s) and or construction works (as per the signed Employer-Contractor Agreement). Hua Hin Solar Co., Ltd., management will be granted the right(s) to do with the confiscated equipment and materials as it wishes. Finally, although Hua Hin Solar Co., Ltd, staff are always considerate and careful, any damage made due to the uninstallation of solar system components in this case will be the responsibility of, and therefore paid for in full by, the owner. The property owner also agrees to also forfeit all payments previously made to Hua Hin Solar Co., Ltd. So please make all necessary preparations to make your payments on time and please do not introduce third parties or third party equipment in conflict with Hua Hin Solar Co., Ltd, contracted works.
Furthermore, if all payments noted on the purchase agreement contract are not paid in full – the customer accepts full responsibility for installed solar equipment on their property by Hua Hin Solar Co., Ltd, and must reach an agreeable financial settlement (within 30 days of discovery of the equipment damage) with the management of Hua Hin Solar Co., Ltd, in regards to replacement or repair of any damage (either by the owner or any third party) to installed solar equipment by Hua Hin Solar Co., Ltd. If no settlement can be reached within the 30 day period then Hua Hin Solar Co., Ltd., management will be granted the right(s) to add the cost of damaged equipment repair/replacement to the contract with the customer as the Hua Hin Solar Co., Ltd determines fair and appropriate.
Again we have not had an issue with our customers to date. Thank you.
Clause 15. Hua Hin Solar workers (on staff or contracted third-party) onsite at the client’s property will have been hired to fulfil the contract for works required specifically (only). If the client directly requests extra works from any Hua Hin Solar worker without the consent of the Hua Hin Solar management we reserve the right to accept / deny the extra work and or charge for the extra work at our company’s charge(s) or rate(s)/hour as per the additional job. Please understand that asking for extra works (paid or favoured) without our knowledge / direct management slows the contracted works down, costs us as a company money or may delay completion of your works.
Clause 16. When you sign the quotation agreement you agree to treat our management, staff and third party workers with the utmost respect and consideration and in a courteous manner. If you as the customer witness that any part of the job is not following the quoted contract please contact our management as soon as and we manage the workers/job as required. Please know that we strive to maintain open communication channels with our clients and thank you for helping us in maintaining high standards and quality control.
Clause 17. Hua Hin Solar spends a considerable amount of time ensuring the accuracy of the contents of its website. Use of the Solar Investment Calculator on our Website
* By using the Solar Investment Calculator you agree and understand fully that the outputs from the Solar Investment Calculator are indicative (estimates only) and should not act as a substitute for a consultation with an accredited solar system design/install professional. You further agree and understand that calculated solar system reductions in electric bills will vary month to month due to, but not limited to, changes in your household power use, local weather patterns and the positions of the sun in the sky throughout they year. Assumes use of Solar Shop Hua Hin European standard PV panels. Outputs are based upon assumed average Thailand solar irradiance conditions collected by the Ministry of Energy for decades.
By making simple changes to your household energy-consumption, you can reduce your bills (see our FAQ section for more details). Unless a Feed-In-Tariff has been allocated for your property, we recommend household and business owners to not oversize their solar system so that electricity generated exceeds daily-energy consumption. In other words, you should size your solar system to help reduce your monthly electric bills but not achieve a zero balance (0 Baht) on your bill at the end of any month. Future increases in electricity billing rates, Feed-In-Tariffs and Government Incentives Programs are not accounted for in calculations. Maintenance costs are also not included by design. This is due to the long life-expectancies of Hua Hin Solar Co., Ltd. systems (solar inverters over 14 years, European Standard solar PV panels between 25 and 30 years).
* By using the Solar Investment Calculator, or in the case that a Hua Hin Solar Co., Ltd staff or agent uses the Solar Investment Calculator to show you estimated outputs for a particular solar system, you agree and understand fully that Hua Hin Solar Co., Ltd., shall not in any case be held responsible for special, incidental, consequential, indirect or other similar damages or losses due to labour, lost profits, revenues or any other legal theory even if Solar Shop Hua Hin or our agent has been advised of the possibilities of such damages for use of (a) calculated result(s)/output(s) for any personal or business activity(ies), recommendation(s) or conclusion(s).
In the event of a dispute regarding the signed Employer-Contractor agreement or the Terms and Conditions pursuant to the agreement and openly displayed (for transparency and ease-of-access for reading) on the website solarshop-huahin.com, all parties shall resolve the dispute peacefully and in good faith. For customers who have requested a hard copy of these Terms and Conditions to be added to their Employer-Contractor agreement for signature by both the buyer and seller then both parties agree that the hard copy inclusion will be utilized exclusively for dispute resolution and therefore will supersede / replace the Terms and Conditions displayed on the website.
Should the dispute remain unresolved, all disputes arising in connection with the transaction contemplated hereby shall be brought before and settled in the civil court of Thailand.
In the event of any dispute, controversy or claim arising from any part of the Employer-Contractor Agreement, both parties agree that the English version of the Agreement and the Terms and Conditions shall prevail and be relied upon.
